Job Description for Circle Operation Management in Legal Function: Responsible for handling all litigation (Consumer/Civil/Criminal/Taxation/Labour etc.) filed by or against company before NCDRC/High Court/State Commission/ District Courts/SDM Courts/Consumer Forums/PLAs across locations in the State of Karnataka. Responsible for drafting and negotiating all kind of Deeds/ commercial contracts/B2B agreements/Agreements/ MoU/ POA / Settlement Deed / Letter of Intent Or Acceptance/ Partner Onboarding Agreements/Service Agreements etc. to ensure that the interest of the Company is protected and legal risks are mitigated. Do verification of properties/Paper books, facilitate legal due diligence of the properties through empaneled counsels and provide the executive summary to the internal team within timelines. Prepare and submit replies to legal notices / notices sent by customers / State Government Authorities / Tehsildar's office / gram panchayats or any other statutory authority with regard to issues related to Products or services offered by the company. Registration of the company properties ie- Offices/Stores/Warehouses etc..., Shall be responsible for timely updation of information/details of all litigations/notices/Paper-books on Notice Management System for review of the Circle L&R Head / Central Legal Team. Analyzing, interpreting and advising business team on legislation, regulation, Guidelines etc. Engage in effective coordination with all internal departments to ensure effective support from legal department for closure of the transaction in line with the agreed timelines. Providing accurate, relevant, and timely advice to stakeholders/business on a variety of legal topics at Circle. Managing and mitigating legal risks by implementing company policies and procedures as communicated by the Center Legal & Regulatory Team time to time. Ensuring compliance with all laws and regulations that apply to the business. Staying up-to-date with changes to legislation, particularly in relation to laws, rules and regulations that directly affect business and telecom industry. Strong communication and presentation skills. Excellent negotiating and drafting skills. The ability to build and maintain strong professional relationships across the cross functional team /business/Industry. The ability to communicate complex legal issues and risks in terms that non-legal colleagues can understand. This position is important & critical in the circle and involves assisting the Head Legal & Regulatory in advising & actioning and handling all the legal issues pertaining to all the departments in the circle. Represent the organization in court proceedings, if required. Prepare legal documents, such as complaints, pleadings and briefs, to support the Business. Serve as Point of Contact for government agencies, including, Local bodies, and other relevant departments for issues related to Infra Deployment / Right of Way etc. Regulatory: Compliance of the provisions of license agreement executed by the company with the Department of Telecommunications (DoT). Compliance to all Regulation, Instructions, Notification etc issued by DoT, the Telecom Regulatory Authority of India (TRAI). To develop & maintain amicable relationship with government bodies DoT / TERM, TRAI, CCA, BSNL and other telecom operators at the circle level. ROW Permissions: Facilitate speedy rollout of towers & fibre through co-ordination with state govt. / local municipal bodies / State or District Broadband Committees, etc. Acquisition support for CTA & Government sites aligned with gazette notification on ROW. To monitor subscriber activation and verification process and sensitize / educate all concerned in this regard. Arrangement of all necessary approvals for supporting business. Due coordination and prompt action during disaster – in coordination with SDMA/LSA unit. Compliance to Roll Out Obligations, EMR testing, Workshop, Re-verification, QOS audit etc. Coordinating with Centre Team for different reporting and compliance issues. Diligent data handling for Govt. reporting especially for parliament questions etc. Addressing inter-operator issues and industry issues though COAI. To guide and assist Circle Nodal Officer. Support concerned functions in closure of all audits pertaining to legal & regulatory. Responsible for closure / resolution of all type of queries pertaining to licensing condition raised by DoT LSA unitl on regular basis. To educate and sensitize the cross functional teams [Sales & CSD] for improvement in acquisition and documentation process helping to increase compliance scores in monthly subscriber verification audits and ensure minimal penalty. Responsible / Coordinate with DoT LSA /TRAI RO Officials for final discussion and closure of monthly joint subscriber verification / documentation audit so as to achieve the satisfactory compliance score on monthly basis.
