Terms of Service

1. Who we are

OpteroAI ("the Service") is operated by OpteroAI Technologies, a company registered in India under the Companies Act, 2013. Our registered office is in Bengaluru, Karnataka, India.

When we say "we," "us," or "OpteroAI," we mean OpteroAI Technologies. When we say "you" or "user," we mean anyone who uses the Service.

2. Acceptance of terms

By creating an account or using OpteroAI, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By creating an account, you confirm that you meet this requirement.

4. Description of Service

OpteroAI is an AI-powered job search platform that scores job listings based on your profile and preferences, tracks your applications via Gmail and a browser extension, and provides AI-generated recommendations to improve your job search outcomes. The Service includes:

• A web application at optero.ai
• A Chrome browser extension
• Gmail integration for application tracking
• AI-powered matching, scoring, and insights
• Related APIs and backend services

5. User accounts

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate information during registration. You may not create multiple accounts or share your account with others.

6. Your data and content license

You retain ownership of all data you provide to OpteroAI, including your resume, profile information, preferences, and any other content you upload or share.

By using the Service, you grant OpteroAI a limited, non-exclusive, revocable license to process your data (including resume, profile data, job preferences, salary expectations, and email content when Gmail is connected) solely for the purpose of providing and improving the Service. This includes sending relevant data to AI models for scoring, matching, and generating recommendations.

You may delete your data at any time from your account settings, which revokes this license.

7. AI disclaimer

OpteroAI uses artificial intelligence (Claude by Anthropic, via Google Cloud Vertex AI) to score job matches, generate recommendations, classify emails, and provide insights. These AI-generated outputs are informational suggestions only. They are not guarantees of employment outcomes, professional career advice, or endorsements of any employer.

You acknowledge that AI outputs may occasionally be inaccurate, incomplete, or biased. You should exercise your own judgment when making career decisions based on information provided by the Service.

8. Payments

OpteroAI uses a success-based pricing model:

• Activation fee: A one-time fee of INR 1 (or equivalent) when you begin applying through the platform.
• Success fee: A one-time fee charged when you receive a confirmed job offer, based on the salary band of the offer. See the pricing page for details.
• Student exemption: Students and fresh graduates are exempt from the success fee on their first confirmed offer.

All payments are processed through third-party providers (Razorpay for India, Paddle for international users). We do not store your payment card details. Fees are non-refundable except where required by applicable law.

9. Prohibited conduct

You agree not to:

• Use the Service for any unlawful purpose
• Scrape, harvest, or systematically extract data from the Service
• Impersonate another person or misrepresent your identity or qualifications
• Interfere with, disrupt, or overload the Service infrastructure
• Reverse-engineer, decompile, or disassemble any part of the Service
• Attempt to circumvent payment obligations or manipulate application statuses
• Use the Service to apply to jobs you have no genuine interest in
• Share your account credentials with third parties

10. Intellectual property

The Service, including its design, code, AI models, algorithms, scoring methodology, and brand assets, is owned by OpteroAI Technologies. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

11. Limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, OpteroAI and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.

Our total liability for any claim arising from these terms or the Service shall not exceed the amount you paid to OpteroAI in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless OpteroAI from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these terms, or your violation of any rights of a third party.

13. Termination

You may delete your account at any time from the settings page. Upon deletion, your personal data will be permanently removed within 30 days.

We may suspend or terminate your access to the Service at any time if you violate these terms, engage in prohibited conduct, or if we reasonably believe your use poses a risk to the Service or other users. We will make reasonable efforts to notify you before or promptly after any such action.

14. Governing law and disputes

These terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any disputes arising out of or relating to these terms or the Service shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

Before initiating formal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least 30 days.

15. Modifications to terms

We may update these terms from time to time. Material changes will be communicated via email or an in-app notice at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised terms.

If you do not agree with the updated terms, you may delete your account before the effective date.

16. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
